Welcome to Creatures of Habit! These Terms of Service ("Terms") govern your access to and use of the Creatures of Habit mobile application (the "App"), operated by Habit Creatures, Inc. ("Habit Creatures," "we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

2. Accounts

a. Account Creation

To use certain features, you may be required to create an account, including via:

  • Sign in with Apple
  • Email registration (when available)

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

b. Usernames & Avatars

  • You may choose a unique username, which may be visible to other users
  • Avatars are selected from pre-made options
  • Usernames must not impersonate others or violate community standards

We reserve the right to modify or reclaim usernames that violate these Terms.

3. App Functionality & Health Data

Creatures of Habit uses Apple HealthKit step and distance data (with your permission) to:

  • Track walking progress
  • Unlock gameplay content
  • Populate leaderboards and aggregated statistics

The App does not track location and does not collect health data beyond steps and distance.

4. Leaderboards & Community Features

The App may display:

  • Public or semi-public leaderboards
  • Aggregated or anonymized user statistics
  • Social or community features

You acknowledge that:

  • Your username and progress metrics may be visible to other users
  • Leaderboard rankings are for entertainment and motivation purposes only

5. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes
  • Harass, abuse, or harm other users
  • Attempt to manipulate leaderboards or falsify activity data
  • Reverse engineer, scrape, or interfere with the App
  • Use bots or automated systems to access the App

We may suspend or terminate accounts that violate these rules.

6. User Content

You retain ownership of content you submit, such as optional screenshots or shared progress.

By submitting content, you grant Habit Creatures a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content solely in connection with operating and promoting the App.

7. Subscriptions & Payments

a. Subscriptions

Creatures of Habit may offer paid subscriptions in the future.

  • Payments are processed through Apple In-App Purchases
  • Pricing, billing periods, and features will be disclosed at purchase
  • Subscriptions automatically renew unless canceled through your Apple account

b. No Refunds

All purchases are subject to Apple's refund policies. Habit Creatures does not issue refunds directly.

8. Intellectual Property

The App and all associated content—including artwork, creatures, characters, graphics, text, and code—are owned by Habit Creatures or its licensors.

You may not copy, modify, distribute, or create derivative works without our permission.

9. Termination

We may suspend or terminate your access to the App at any time if:

  • You violate these Terms
  • You engage in harmful or abusive behavior
  • The App is discontinued

You may stop using the App at any time and request account deletion by contacting support@habitcreatures.com.

10. Disclaimer of Warranties

The App is provided "as is" and "as available."

We make no warranties regarding:

  • Accuracy of step or distance data
  • Continuous availability of the App
  • Fitness or health outcomes

Creatures of Habit is not a medical or fitness service and does not provide medical advice.

11. Limitation of Liability

To the maximum extent permitted by law, Habit Creatures shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data or progress
  • Injuries or health outcomes related to use of the App

Your sole remedy is to stop using the App.

12. Indemnification

You agree to indemnify and hold harmless Habit Creatures from any claims arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of applicable laws or rights of others

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
